In essence, (current California AG) Jerry Brown asserts that he is personally (morally) with the voters in rejecting gay marriage. But he also believes that the US Supreme Court has addressed this, and that there is a "liberty interest" that has been established by the California Supreme Court's granting of current same sex marriage.

Brown says that he is forced the challenge Prop 8 based on his interpretation of Federal law, as Lynch was forced to do regarding a Fair Housing case in 1968. In that Fair Housing case, the voters sought to "strip away" a portion of the Fair Housing Act. The beginning of this article is decent enough to make the basic point.

California's Prop 8 is headed to the US Supreme Court. If it is defeated (deemed unconstitutional), Brown will be able to draw an even greater legal kinship with Lynch (concerning Lynch's arguments against Proposition 14) in opposing the will of the majority.

Thomas C. Lynch has been resurrected by Prop 8. The case against Proposition 8 has legs, as did Lynch's case against Prop 14.
